Segmented Denomination-Based Recharge Offer

TERMS AND CONDITIONS

Tata Play Limited (“Tata Play”) is running a personalised segmented recharge offer (“Offer”) for selected subscribers on the Tata Play platform.

Tata Play Service shall mean to include all the channels and platform services offered by Tata Play on the direct to home platform of Tata Play.

Eligible Subscriber shall mean any subscriber availing Tata Play Services on its direct-to-home platform and recharges their Tata Play account via eligible recharge sources for the designated denomination(s) specified under the Offer, and who has received promotional communications relating to the Offer through outbound calls, inbound calls, dealers, or digital platforms.

Tata Play Segmented Denomination Cashback Offer (‘Offer’) is a promotional offer being offered by Tata Play for a limited period for its Eligible Subscriber.

This Offer shall continue until the same is withdrawn or modified by Tata Play in its sole discretion.

Eligible Subscriber can receive cashback on selected recharge denominations, subject to these terms and conditions.

Eligible Subscriber will be presented with specific recharge denomination(s) ranging between ₹301 to ₹851; and on successful recharge of the exact recommended amount, the subscriber will receive an instant cashback ranging from ₹20 to ₹50, depending on the segment.

The Offer is promoted via outbound call centre/inbound call centre/dealers/digital platforms. The Eligible Subscriber needs to recharge for the exact amount in single instance irrespective of negative balance and the cashback value may vary across subscribers and over time.

This Offer can be availed only once per subscriber during the Duration Period and once the Offer is availed or rejected, it cannot be availed again unless the same Offer is reissued to the subscriber by Tata Play.

In addition to the terms and conditions stated here, the Eligible Subscriber shall be bound by the terms and conditions stipulated in the Hardware Warranty Terms And Conditions, Specific Terms and Conditions of Tata Play, Subscription Contract and/or Specific Terms and Conditions of Tata Play Subscription Contract for Tata Play Hardware provided on Entrustment basis and/or Everywhere TV Terms and Conditions and other terms and conditions, found on Tata Play's website tataplay.com. The documents referred here along with the present Terms and Conditions shall be referred herein as ‘Subscription Contract’ for the Eligible Subscriber.

This Offer cannot be used in conjunction with any other alternative offer or promotion of a similar nature.

This Offer is valid only up to the Duration Period and after the completion of the Duration Period, no Eligible Subscriber shall be entitled for the Offer.

In case of recharge reversal or cancellation, any cashback availed under this Offer shall be withdrawn or reversed by the Tata Play.

Tata Play shall not be responsible in case of any incorrect recharge amount, network problems such as breakdown of machinery, unclear network, disruption in the network and/or the charges that may be payable by the Eligible Subscriber to any network operator including any premium rates that may be charged by the network operator. Eligible Subscriber must check with their respective network operators regarding the charges payable to the network operator before using any of the methods mentioned above. Any dispute in connection with the same should be settled between the Eligible Subscriber and the network operator without involving Tata Play.

Tata Play reserves the right at any time, without prior notice, without assigning any reason and without any liability whatsoever, to add or vary all or any of the terms and conditions or to replace, wholly or in part this Offer or to withdraw it completely.

By availing this Offer and subscribing to the Tata Play Services, it shall be deemed to be construed that the Eligible Subscriber has read and consented to the terms and conditions stated herein and in the Subscription Contract.

The Eligible Subscriber and/or any person through the Eligible Subscriber waives any and all right that such an individual may have to claim ambiguity in these terms and conditions and agrees to releases, indemnifies and hold harmless Tata Play and its respective affiliates, advertising and promotion agencies, and its respective agents, partners, representatives, officers, directors, shareholders and employees from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from the Eligible Subscriber availing this Offer.

Tata Play shall not be responsible for printing or typographical errors in any promotional materials; or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, mail system, human or other error; or for electronic, computer, or telephonic malfunction or error, including inability to access the Tata Play website or process any transaction thereon.

Failure by Tata Play to enforce any of the Terms and Conditions in any instance shall not be deemed to be a waiver of those Terms and Conditions and shall not give rise to any claim by any person.

Eligible Subscriber hereby authorize Tata Play to collect their personal information including name and mobile number etc. and share with its partners so as to enable and to avail the Offer.

This Offer is subject to force majeure circumstances i.e., Act of God or any circumstance beyond the reasonable control of Tata Play.

All capitalized terms used herein shall have the same meaning as ascribed to them in the Subscription Contract.

In the event of any inconsistency between the Subscription Contract and these Terms and Conditions, in so far as this Offer is concerned, the latter shall prevail.

Headings used herein are for convenience only and do not affect the interpretation of this Offer Document.

The Offer shall be governed in accordance with the laws of India, and the courts of New Delhi shall have sole and exclusive jurisdiction to adjudicate on any disputes arising from the Offer.
